Launchers and Ammo

It is important to note that Military Surplus 37 mm Launchers are not firearms and should not be used to fire any round meant for a firearm. This includes 12 gauge or centerfire rounds, rimfire rounds, and Beehive rounds. Attempting to fire any of these rounds using an adapter can cause damage to the launcher as well as serious harm to yourself. It is also important to note that violating this warning can lead to severe legal consequences, as it violates BATF rules. Please review this LAWS AND LEGALITY Policy for more information. Please note that the warranty will be void if any of these conditions are violated.

Buyers Statement & Liability Release

Military Surplus requires your agreement to the following buyer’s statement & liability release. By placing an order with us you certify that you have read, understand, and agree to the sales conditions and liability release as follows:

Launchers sold by Military Surplus, its subsidiaries, and related companies require NO licenses as the BATF Technology Branch has reviewed and designated these products as non-weapons. They are not firearms and must be used as intended: as intended as a life-saving signaling device, and these launchers are not designed for or legal to use with any projectiles, shells, or cartridges other than signal flares and smoke. Any modification from its original configuration or unintended use may be in violation of federal and state law. Purchaser acknowledges that purchase of this product may not permitted in some jurisdictions. The purchaser acknowledges a duty to review all federal, state, and local laws and regulations and further represents and warrants full compliance with all laws and regulations that apply to any purchase.
Orders must be placed by the actual recipient of the product.
Buyer acknowledges that some launchers sold by Military Surplus may be pre-owned or surplus, and Military Surplus has no knowledge of the prior use, care, or maintenance of such product. Such products have not been fired or tested by Military Surplus or by any other experienced professional, and Military Surplus encourages you to have such products inspected by an experienced professional prior to use if you have questions about their capability.
Further, the purchaser of any Launcher or Ammunition product sold on this site agrees to the following:
1. I am 21 years of age or older, fully and legally qualified to receive merchandise ordered;
2. I am not prohibited from receiving ammunition or other products pursuant to 18 U.S. Code § 922 d;
3. I fully understand that merchandise ordered may be dangerous to use or store and I understand the nature, safety precautions, characteristics and risks to health, of storage, use, or other personal control;
4. I will keep all merchandise completely under my control;
5. I will use and/or store all merchandise out of the reach of children and in full compliance with local, state, and federal laws;
6. I understand that neither Military Surplus nor any employee, agent or in any part thereof extend any warranties expressed or implied or to make any statement of usage;
7. I fully, without reservation or condition, agree to absolve and hold harmless and indemnify Military Surplus, all employees, agents, or any in part thereof from all injuries resulting in any way from the purchase, use, possession, distribution, sale/resale, transportation, handling and/or storage of merchandise or items/substances made from same;
8. I furthermore agree to reimburse Military Surplus or any agent thereof for any and all costs, fees, or expenses in defense of any claims or judgments that may arise as a result of the purchase, transportation, handling, possession, storage, sale/resale and/or use of merchandise ordered.
9. I agree that all terms and conditions of this statement and sale apply equally to all purchases, past, present, and future, as well as orders called in by telephone.
10. I have read, understand, and agree fully, without reservation or condition listed herein, and signify such understanding and agreement by placing an order.

Stun Guns Shipping Restrictions:

Please Note: Stun Guns are illegal in the state of Massachusetts, Rhode Island and U.S. Virgin Islands. They are also illegal in Chicago, Illinois, The District of Columbia and Nassau County, New York.

We WILL NOT SHIP to the above locations or any other location where they are illegal. If you live in an area where they are illegal please refrain from purchasing Stun guns. We will NOT SHIP to you and will remove the items from your order.

Blank Guns Shipping Restrictions:

Please Note: Blank Guns are illegal in the state of Maryland, New Jersey, Rhode Island, New York, Connecticut, Minnesota, Wisconsin, Washington, D.C. and Puerto Rico. They are also illegal in the City of Chicago, IL , Aurora, IL and Topeka, KS. BB and Pellet Guns are illegal in New York City & it’s 5 boroughs: Manhattan, Brooklyn, Bronx, Queens & Staten Island. They are also illegal in Washington, DC , Philadelphia, PA , Chicago, IL , San Francisco , CA and in the state of New Jersey.

Gravity Knives (Butterfly and OTF):

We WILL NOT SHIP to the States: Delaware, District of Columbia, Hawaii, Maryland, Minnesota, New Jersey, New Mexico, New York, Washington or any other location where they are illegal. If you live in an area where they are illegal please refrain from purchasing. We will NOT SHIP to you and will remove the items from your order.

Automatic Knives Agreement:

IN COMPLIANCE WITH FEDERAL STATUTES REGARDING INTERSTATE SHIPPING OF AUTOMATIC KNIVES, Military Surplus requests that you read carefully the requirements set forth below, and agree to this prior to your purchase or receipt of any automatic opening knife from our company.

Federal law prohibits the shipment of automatic knives across state lines, with the following exceptions:

to civilian or Armed Forces supply or procurement officers and employees of the Federal Government ordering, procuring, or purchasing such knives in connection with the activities of the Federal Government;
an active Armed Forces member or employee acting in the performance of his or her duty;
to supply or procurement officers of the National Guard, the Air National Guard, or militia of a State, Territory or the District of Columbia ordering, procuring, or purchasing such knives in the connection with the activities of such organization;
to supply or procurement officers or employees of the municipal government of the District of Columbia or the government of an State or Territory, or any county, city or other political subdivision of a State or Territory;
to manufacturers of such knives or bona fide dealers therein in connection with any shipment made pursuant of an order from any person designated in paragraphs 1, 2, 3 and 4.
Military Surplus will not sell automatic opening knives to any customer unless such sale or receipt of Product Service return is made in compliance with one or more of the above conditions.

By placing an order with us you certify that you have read, understand and agree to the sales conditions and liability release and hereby recognize and acknowledge that it is your responsibility as the buyer to ascertain and obey all applicable laws (local, state, federal and international) in regard to the possession or purchase of any item from Military Surplus. You further hereby represent and certify that your purchase or ownership of automatic opening knives from Military Surplus meets one or more of the criteria set forth above and agree to use these knives in connection of duties as described above in sections 1, 2, 3, 4 and 5.

Military Surplus warrants the above to be true according to the best available information. However, it is crucial for buyers to understand that they are ultimately responsible for verifying local, state, and federal laws.

Liability

You assume absolute and complete responsibility for any outcome from using our Products. Any damage to persons or property that occurs through the use of our Products by you or anyone else who obtains them from you, by any means, is your responsibility. This includes negligent or careless use. It is absolutely and completely on you. Therefore, by placing an order and taking delivery of any of our Products, you affirm that you agree completely and without reservation or exception to your absolute liability and responsibility for all and any use associated with said Products.
